EXPLANATORY
STATEMENT
This Bill amends the Work Health
Act.
The purpose of this Bill is to enhance
the transparency and independent nature of the Work Health Advisory Council
(WHAC) by appointing an independent chairperson and mandating that one of the
ten positions is for the Chief Executive of the Department of Employment,
Education and Training or delegate.
Section 20
of the Northern Territory Work Health Act makes provision for a WHAC.
The Minister responsible for work health appoints members of the WHAC under the
powers granted by the Work Health Act. The Council presently
consists of the Chief Executive Officer, who is the chairperson, and not more
than ten other members who are ministerial
appointments.
The issue of the appointment of
an independent chairperson for the WHAC has been considered at WHAC meetings and
also by industry stakeholders including employers, unions, the Insurance Council
of Australia and legal representatives who all expressed a strong preference to
appoint an independent chairperson of the
WHAC.

This Act comes into
operation on the date fixed by the Administrator by notice in the
Gazette.

The Act amends the Work Health
Act.
Clause 4. Amendments of section 19
(Definitions)
Includes the definition of
“appointed member”.
Clause
5. Amendment of section 20 (Work Health Advisory
Council)
Makes provision for the council to
consist of the Chief Executive and not more than ten other members appointed by
the Minister, one of whom will be appointed as the Chairperson.
The schedule outlining the changes in wording from
section 21 through to 24 has effect.
