Health Practitioner Registration and Other Legislation Amendment Bill 2012


Objectives of the Amendments
The amendments to be moved during consideration in detail will correct minor typographical
and cross referencing errors.

The Health Practitioner Registration and Other Legislation Amendment Bill 2012 (the Bill)
substantially amends the Health Practitioners (Professional Standards) Act 1999 (the
Professional Standards Act). These amendments rescind components of the Professional
Standards Act that apply only to the registration of dental technicians and speech
pathologists, and leave in place the provisions that apply to nationally registered professions.
As a result of these amendments, the Schedule (Dictionary) to the Professional Standards Act
also required significant amendment to omit obsolete terms and definitions and to signpost
terms that are defined within the remaining parts of the Act.

During its consideration of the Bill, the Health and Community Services Committee
identified a minor typographical error and a cross-referencing error in clause 55 of the Bill,
relating to the definitions for repealed act and commencement in the amended Schedule
(Dictionary) to the Professional Standards Act.

The proposed amendments do not change the policy intent of the Professional Standards Act
or the amendments made to that Act in the Bill.

Health Practitioner Registration and Other Legislation Amendment Bill 2012 Achievement of the Objectives The proposed amendments will be achieved by amending clause 55 of the Bill to remove or correct cross references to sections in the Professional Standards Act. Alternative Ways of Achieving Policy Objectives There are no alternative ways of achieving the policy objectives. Advice from the Office of the Queensland Parliamentary Counsel indicates that, although the errors are minor, the amendments fall outside the scope of the Reprints Act 1992. Estimated Cost for Government Implementation The amendment will not incur any additional costs. Consistency with Fundamental Legislative Principles The amendments are consistent with fundamental legislative principles. Consultation The Department of the Premier and Cabinet has been consulted. Due to the minor nature of the proposed amendments, and their consistency with the issues raised by the Health and Community Services Committee, no further consultation was undertaken. NOTES ON PROVISIONS Amendment 1 Clause 55 (Amendment of schedule (Dictionary)) Amendment 1 amends the definition of repealed act in clause 55(2) of the Bill to omit paragraph (b), which refers the reader to section 406 of the Professional Standards Act. Section 406 of the Professional Standards Act does not refer to the term repealed act, so this `signpost' in the Dictionary is incorrect. Amendment 2 Clause 55 (Amendment of schedule (Dictionary)) Amendment 2 amends the definition of commencement in clause 55(4) of the Bill to omit the reference to section 406A and replace it with section 406. This corrects a typographical error, as there is no section 406A in the Professional Standards Act; the term commencement is instead used in section 406. ŠThe State of Queensland 2013 Page 2
