Management committee to ensure association has appropriate person as secretary
66 Management committee to ensure association has appropriate person as
secretary
(1) The management committee of an incorporated association must ensure the
secretary is an adult residing in Queensland, or in another State but not more
than 65km from the Queensland border, who is— (a) a member of the
incorporated association elected by the association as secretary; or
(b) a
member of the incorporated association’s management committee appointed by
the committee as secretary; or
(c) appointed by the management committee as
secretary (whether or not the adult is a member of the incorporated
association).
Penalty— Maximum penalty for each member of the
management committee—10 penalty units.
(2) It is a defence to a
prosecution of a member of the management committee for an offence against
subsection (1) for the member to prove he or she took all reasonable steps to
ensure the subsection was complied with.
(3) It is declared that— (a) a
secretary mentioned in subsection (1) (a) or (b) is a member of the management
committee; and
(b) a secretary mentioned in subsection (1) (c) is not a
member of the management committee.
