132 Effect of building certifier not complying with Act if no penalty provided

(1) This section applies if—

(a) a building certifier does not comply with a provision of this Act about building or private certifying functions; and

(b) no penalty is stated for the failure to comply.

Examples of provisions mentioned in subsection (1)—

sections 48 , 88 , 102 , 105 , 127 , 128 , 137 and 139

(2) The failure to comply is not an offence.

(3) For the definition of
"unsatisfactory conduct" in schedule 2 , the failure is taken to be conduct that is contrary to a function under this Act.
