(1) This section applies if—(a) there is a wall of a building along the common boundary of 2 parcels of adjoining land; and(b) there is, or is proposed to be, a regulated pool on the adjoining land without the building.
(2) A pool owner may use any part of the wall as part of a pool barrier that would, without alteration, comply with the pool safety standard.Note—The pool owner would need to construct a separate barrier for any part of the wall that does not comply with the pool safety standard. For example, a window in the wall.
(3) However, despite any right of a pool owner under this division, the wall may not be altered, demolished or replaced without the agreement of the owner of the adjoining land on which the building is located.
