Offence to breach conditions of bail
29 Offence to breach conditions of bail
(1) A defendant must not break any condition of the undertaking on which the
defendant was granted bail requiring the defendant’s appearance before a
court. Penalty— Maximum penalty—40 penalty units or 2 years
imprisonment.
(2) Subsection (1) does not apply to— (a) a condition that
the defendant surrender into custody; or Note— For defendants who fail to
surrender into custody, see section 33 .
(b) a condition of the
defendant’s undertaking imposed under section 11 (9) or 11AB .
(3) For the
purposes of the Human Rights Act 2019 , section 43 (1) , it is declared that
this section has effect in relation to a defendant who is a child— (a)
despite being incompatible with human rights; and
(b) despite anything else
in the Human Rights Act 2019 .
Note— Under the Human Rights Act 2019 ,
section 45 (2) , this subsection expires 5 years after the commencement.
