34 Effect of apprehension on another charge of defendant on bail
(1) The apprehension of a defendant who has been released on bail to appear
before a court on another charge shall not vacate the undertaking to which the
bail relates and that undertaking shall continue to bind the defendant and the
defendant’s surety or sureties (if any) until the defendant is discharged or
sentenced in respect of the offence to which the bail relates.
(2)
Notwithstanding subsection (1) , the court may commit to prison a defendant on
bail who is arrested on another charge or may grant bail to the defendant.
(3) Where a defendant who has been released on bail to appear for trial is
committed to prison pursuant to subsection (2) , the sureties (if any) for the
defendant’s appearance are, without other authority than this subsection,
discharged from liability in respect of the bail while the defendant remains
in prison.
