CRIME AND CORRUPTION ACT 2001 - SECT 108
If video cameras monitor place where person is searched
108 If video cameras monitor place where person is searched
(1) If a video camera monitors the area where the person is searched, the
authorised commission officer must, unless the person viewing the monitor is
an authorised commission officer of the same sex as the person being
searched— (a) ensure the camera is turned off; or
(b) conduct the search
out of view of the camera.
(2) If the video camera is not turned off, a
recording of the search must not be shown to anyone other than— (a) the
person searched or his or her lawyer; or
(b) a doctor treating the person
searched; or
(c) a person deciding if a proceeding is to be started against
the person for an offence; or
(d) an authorised commission officer
investigating an offence involving the person; or
(e) an authorised
commission officer, police officer, lawyer, public prosecutor or witness
involved in a proceeding against the person; or
(f) a court.
