Who may be present at consideration of application for surveillance warrant
122 Who may be present at consideration of application for surveillance
warrant
(1) The judge must hear an application for a surveillance warrant in the
absence of anyone other than the following— (a) the applicant;
(b) a
monitor;
(c) someone the judge permits to be present;
(d) a lawyer
representing anyone mentioned in paragraphs (a) to (c) .
(2) Also, the judge
must hear the application— (a) in the absence of the person proposed to be
placed under surveillance (the
"relevant person" ) or anyone likely to inform the relevant person of the
application; and
(b) without the relevant person having been informed of the
application.
