CRIME AND CORRUPTION ACT 2001 - SECT 149
Who may be present at consideration of application
149 Who may be present at consideration of application
(1) The judge must hear an application for a covert search warrant in the
absence of anyone other than the following— (a) the applicant;
(b) a
monitor;
(c) someone the judge permits to be present;
(d) a lawyer
representing anyone mentioned in paragraphs (a) to (c) .
(2) Also, the judge
must hear the application— (a) in the absence of the person the subject of
the application (the
"relevant person" ) or anyone likely to inform the relevant person of the
application; and
(b) without the relevant person having been informed of the
application.
