Commission officer may use assistance in exercising particular powers
172 Commission officer may use assistance in exercising particular powers
(1) It is lawful for a commission officer exercising a power under this Act—
(a) to seek the assistance of another person (an
"assistant" ) the officer reasonably requires for performing a function of the
commission; or
(b) to take onto a place any assistant, equipment, vehicle,
animal or material the officer reasonably requires for exercising the power.
Examples— 1 A commission officer may seek the help of an electrician to
install a listening device under a surveillance warrant.
2 A commission
officer may seek the help of a translator to interpret conversations and
visual images recorded using a surveillance device.
(2) The commission
officer may authorise the assistant— (a) to take stated action at the place;
and
(b) to exercise stated powers the commission officer is authorised to
exercise.
(3) However, the commission officer can not authorise the assistant
to apprehend a person.
(4) The commission officer must, if practicable, tell
the assistant— (a) of the action the assistant is authorised to take; and
(b) of the assistant’s powers under this section.
(5) Subsection (1)
applies, in relation to animals, despite any other Act or law.
