Role of chief executive officer
253 Role of chief executive officer
(1) The chief executive officer is responsible to the commission for the
administration of the commission.
(2) The chief executive officer is to—
(a) perform the functions, and exercise the powers, of the commission
delegated to the chief executive officer under section 269 ; and
(b) perform
the functions and exercise the powers delegated to the chief executive officer
by the chairperson; and
(c) perform the other functions, and exercise the
other powers, conferred on the chief executive officer under this Act.
(3) In
performing a function or exercising a power under this Act, the chief
executive officer is subject to the direction of— (a) for a function or
power delegated to the chief executive officer by the chairperson—the
chairperson; or
(b) otherwise—the commission.
(4) The chief executive is
to report to the commission on— (a) all matters relating to the
administration of the commission; and
(b) the performance of the functions
and exercise of the powers mentioned in subsection (2) (a) and (c) .
(5)
Anything done in the commission’s name by the chief executive officer or
chief executive officer’s delegate is taken to have been done by the
commission.
