CRIME AND CORRUPTION ACT 2001 - SECT 402
Acting chairperson
(1) This section applies to a person who, immediately before the commencement
day, holds an appointment to act as the chairperson of the commission. Note—
See section 397 in relation to the continuation of the person’s appointment
to act as the chairperson until the commencement day.
(2) The person is
appointed to act as the chairman of the commission— (a) from the start of
the commencement day; and
(b) until the earlier of the following— (i) 31
October 2014;
(ii) the day a person’s appointment as chairman under
section 229 takes effect.
(3) The person’s appointment and employment to
act as the chairman of the commission is subject to the same terms and
conditions applying to the person’s appointment and employment to act as the
chairperson before the commencement day (other than the duration of that
appointment).
(4) Until the person’s appointment to act as the chairman of
the commission ends under subsection (2)(b)— (a) a reference in a provision
of this part to the chairman is taken to be a reference to the person; and
(b) for that purpose, the provision applies with necessary changes.
(5)
Subsection (6) applies if the person is appointed as a commissioner from the
day the person’s appointment under subsection (2) ends.
(6) The period for
which the person was appointed to act as the chairperson immediately before
the commencement day, and the period of the person’s appointment under
subsection (2), is to be counted as a period for which the person holds office
in the commission as a commissioner for the purposes of section 231(3).
