CRIME AND CORRUPTION ACT 2001 - SECT 55D
Authorising immediate response
55D Authorising immediate response
(1) This section applies if the reference committee is satisfied there are
reasonable grounds to suspect that a criminal organisation or a participant in
a criminal organisation has engaged in, is engaging in, or is planning to
engage in, an incident that threatens, has threatened or may threaten public
safety.
(2) The reference committee may authorise the commission to do either
or both of the following in response to, or to prevent, the threat to public
safety— (a) undertake an investigation into the incident;
(b) conduct a
hearing in relation to the incident.
(3) The authorisation must be in writing
and identify— (a) the criminal organisation or participant that has engaged
in, is engaging in, or is planning to engage in, the incident; and
(b) the
nature of the incident; and
(c) the purpose of the investigation or hearing.
(4) The authorisation may be made by the reference committee— (a) on its own
initiative; or
(b) if asked by the senior executive officer (crime) or the
senior executive officer (corruption).
