CRIME AND CORRUPTION ACT 2001 - SECT 89
Search warrant may be a confidential document
89 Search warrant may be a confidential document
(1) If the search warrant provides that it is a confidential document, a
person must not disclose the existence of the warrant to anyone else unless
the person has a reasonable excuse. Penalty— Maximum penalty—85
penalty units or 1 year’s imprisonment.
(2) It is a reasonable excuse for
a person to disclose the existence of the warrant if— (a) the disclosure is
made— (i) for the purpose of seeking legal advice in relation to the warrant
or an offence against subsection (1) ; or
(ii) for the purpose of obtaining
information in order to comply with the warrant; or
(iii) for the purpose of
making a complaint to the commission or the parliamentary committee about the
warrant; or
(iv) in the course of the administration of this Act; and
(b)
the person informs the person to whom the disclosure is made that it is an
offence to disclose the existence of the warrant to anyone else unless the
person has a reasonable excuse.
