Reimbursement of representative party’s costs
(1) If the court makes an award of damages in a representative proceeding, any
person who is or was a representative party or a
sub-group representative party in the proceeding may apply to the court for an
order under this section.
(2) If, on an application under this section, the
court is satisfied the costs reasonably incurred in relation to the

recoverable by the applicant from the defendant, the court may order an amount
equal to the whole or part of the excess be paid to the applicant out of the
damages awarded.
(3) On an application under this section, the court may also
make any other order it considers just.
