Regulation-making power
107 Regulation-making power
(1) The Governor in Council may make regulations under this Act.
(2) In
making a regulation prescribing a discount rate for section 61 , the Governor
in Council may prescribe a positive, zero or negative rate.
(3) In
recommending the making of a regulation prescribing a discount rate for
section 61 , the Minister must have regard to the following factors— (a) the
prevailing rates of inflation;
(b) the prevailing yields on fixed term
investments;
(c) the prevailing yields on investments in equities;
(d) the
other economic factors the Minister considers are relevant to prescribing an
appropriate discount rate.
