Queensland Consolidated Acts Queensland Consolidated ActsA civil partnership is void if—
(a) either party did not meet the eligibility criteria in section 5 when the relationship was registered as a civil partnership; or
(b) either party did not freely enter into the civil partnership because—(i) the party’s agreement to enter into the civil partnership was obtained by duress or fraud; or(ii) the party was mistaken about the identity of the other party or the nature of the declaration under section 11 ; or(iii) the party did not have the capacity within the meaning of the Guardianship and Administration Act 2000 to enter into the civil partnership.
