DOMESTIC AND FAMILY VIOLENCE PROTECTION ACT 2012 - SECT 67
Condition for protection of unborn child
67 Condition for protection of unborn child
(1) This section applies if an aggrieved is pregnant when a domestic violence
order for the benefit of the aggrieved is made.
(2) The court may impose a
condition that— (a) takes effect when the child is born; and
(b) requires
the respondent to be of good behaviour towards the child, not commit
associated domestic violence against the child, and not expose the child to
domestic violence.
(3) The court may impose the condition if the court is
satisfied that the aggrieved is pregnant and the order is necessary or
desirable to protect the child from associated domestic violence, or being
exposed to domestic violence, once the child is born.
(4) To remove any
doubt, it is declared that the court may impose the condition whether or not
the respondent is the father of the child.
