Confidentiality of criminal history
110 Confidentiality of criminal history
(1) A public service employee performing functions under this Act must not,
directly or indirectly, disclose to anyone else— (a) a report about a
person’s criminal history, or information contained in the report, obtained
under section 105 ; or
(b) a notice about a change in a person’s criminal
history, or information contained in the notice, given under section 108 .
Penalty— Maximum penalty—100 penalty units.
(2) However, a person
does not contravene subsection (1) if— (a) the disclosure of the report,
notice or information is authorised by the chief executive but only to the
extent necessary to perform a function under or relating to this Act; or
(b)
the disclosure is otherwise required or permitted by law.
(3) The chief
executive must— (a) destroy a report about a person’s criminal history
obtained under section 105 as soon as practicable after considering the
report; and
(b) destroy a notice about a change in a person’s criminal
history given under section 108 as soon as practicable after considering the
notice.
