Meaning of analogue
4A Meaning of analogue
(1) A thing is an
"analogue" of a dangerous drug if it is any of the following in relation to
the dangerous drug, regardless of how the thing is made— (a) a structural
isomer with the same constituent groups;
(b) an alkaloid;
(c) a structural
modification that is any of the following— (i) the replacement of up to 2
carbocyclic or heterocyclic ring structures with different carbocyclic or
heterocyclic ring structures;
(ii) the addition of hydrogen atoms to 1 or
more unsaturated bonds;
(iii) the replacement of 1 or more of the groups or
atoms stated in subsection (2) with 1 or more of the other groups or atoms
stated in that subsection;
(d) any other homologue.
(2) For subsection (1)
(c) (iii) , the following groups and atoms are stated— (a) alkoxy, cyclic
diether, acyl, acyloxy, mono-amino or dialkylamino groups with up to 6 carbon
atoms in any alkyl residue;
(b) alkyl, alkenyl or alkynyl groups with up to 6
carbon atoms in the group, where the group is attached to oxygen, nitrogen,
sulphur or carbon; Example— an ester or ether group attached to oxygen
(c) halogen, hydroxy, nitro or amino groups;
(d) hydrogen atoms;
(e)
carbonyl, ester or amide groups.
(3) In this section—
"addition" has its ordinary meaning.
"replacement" has its ordinary meaning.
