191 Offences relating to ballot papers
(1) A person must not— (a) wilfully fail to comply with section 107 (10) (c)
, 117 (5) (d) , 118 (3) (c) or (d) or 119 (8) (c) or (d) ; or
(b) take a
ballot paper out of a polling place otherwise than as authorised by this Act;
or
(c) place in a ballot box a ballot paper that has not been— (i) given to
an elector under this Act; or
(ii) marked by the elector.
(2) A person must
not, without lawful excuse, obtain possession of, or have in the person’s
possession— (a) a ballot paper that has been marked by another person; or
(b) a declaration envelope that has been signed by another person.
Penalty— Maximum penalty—20 penalty units or 6 months imprisonment.
