Termination of appointment
25 Termination of appointment
(1) The Governor in Council may terminate the appointment of a senior
electoral officer for misbehaviour or physical or mental incapacity.
(2) The
Governor in Council must terminate a senior electoral officer’s appointment
if the senior electoral officer— (a) accepts nomination for election to an
Australian parliament; or
(b) becomes a member of a political party; or
(c)
becomes bankrupt, applies to take the benefit of any law for the relief of
bankrupt or insolvent debtors, compounds with creditors or makes an assignment
of remuneration for their benefit; or
(d) is absent, without leave of absence
and without reasonable excuse, for— (i) 14 consecutive days; or
(ii) 28
days in any year; or
(e) contravenes section 12 without reasonable excuse; or
(f) engages in paid employment outside the duties of the office without the
Minister’s approval.
