Decision to refuse application
302 Decision to refuse application
(1) If the commission decides to refuse the application, the commission must
give the third party written notice of the decision as soon as practicable
after making the decision.
(2) The notice must state— (a) the commission
has decided to refuse the application for registration; and
(b) the reason
for the refusal; and
(c) if the reason for the refusal is the application is
incomplete or incorrect—that the third party may— (i) amend the
application in the way stated in the notice; and
(ii) resubmit the
application to the commission within 30 days after receiving the notice.
(3)
An application that is amended and resubmitted to the commission under
subsection (2) (c) is taken to have been made on the day the original
application was made.
