ENVIRONMENTAL PROTECTION ACT 1994 - SECT 183

183 Applicant may give notice about referral to Land Court

(1) The applicant may, by written notice to the administering authority—

(a) request that the administering authority refer the application to the Land Court; or

(b) notify the administering authority that the applicant does not intend to ask for a referral of the application to the Land Court.

(2) A request under subsection (1) (a) must be given to the administering authority within 20 business days after the notice under section 181 (1) is given.

(3) If the applicant gives a notice under subsection (1) (b) , the applicant can not later make a request under subsection (1) (a) .

(4) This section does not apply for a decision made by the administering authority to refuse an application under section 173 (1) .
