Administering authority may require additional information
299 Administering authority may require additional information
(1) The administering authority may, within 10 business days after receiving
the application, give the holder a written notice asking the holder to provide
further information the authority requires to make the ERC decision.
(2) The
administering authority may, by written notice given to the holder, extend the
period within which the administering authority may make a request under
subsection (1) by no more than 10 business days.
(3) The notice mentioned in
subsection (2) — (a) may only be given once by the administering authority
for the application; and
(b) must be given before the period mentioned in
subsection (1) ends.
(4) The period within which the administering authority
may make a request under subsection (1) may be further extended if the holder,
at any time, agrees in writing to the further extension.
(5) The notice
asking the holder to provide further information must state a period of at
least 10 business days within which the information must be given.
(6) If the
holder does not comply with the notice, the administering authority may make
the ERC decision without the further information.
