ENVIRONMENTAL PROTECTION ACT 1994 - SECT 318YR
Show cause notice
(1) The chief executive must give a notice under this section (a
"show cause notice" ) to the owner of a recognised accreditation program if
the chief executive proposes to take any of the following actions (the
"proposed action" )— (a) direct the owner to amend the program;
(b) amend a
condition of the recognition of the program;
(c) suspend or cancel the
recognition of the program.
(2) The show cause notice must state each of the
following— (a) the proposed action;
(b) if the proposed action is to direct
the owner to amend the accreditation program or a condition of the program’s
recognition— (i) the proposed amendment; and
(ii) the reasons for the
proposed amendment;
(c) if the proposed action is to suspend or cancel the
recognition of the program— (i) the ground for the proposed action; and
(ii) an outline of the facts and circumstances forming the basis for the
ground;
(d) if the proposed action is to suspend the recognition of the
program—the proposed suspension period;
(e) that the holder may, within a
stated period (the
"show cause period" ), make written representations to the chief executive to
show why the proposed action should not be taken.
(3) The show cause period
must end at least 28 days after the holder is given the show cause notice.
