ENVIRONMENTAL PROTECTION ACT 1994 - SECT 330
What is a transitional environmental program
(1) A
"transitional environmental program" is a specific program that, when complied
with, achieves compliance with this Act for the activity to which it relates
by doing 1 or more of the following— (a) reducing environmental harm caused
by the activity;
(b) detailing the transition of the activity to an
environmental standard;
(c) detailing the transition of the activity to
comply with— (i) a condition of an environmental authority for the activity;
or
(ii) a development condition; or
(iii) a prescribed condition for
carrying out a small scale mining activity; or
(iv) an
agricultural ERA standard that applies to an agricultural ERA.
(2) However, a
transitional environmental program must not be used to achieve compliance
with— (a) an enforceable undertaking; or
(b) a PRCP schedule.
