ENVIRONMENTAL PROTECTION ACT 1994 - SECT 41
Submission
41 Submission
(1) The proponent must submit to the chief executive draft terms of reference
for the EIS that allow the purposes of the EIS to be achieved for the project.
(2) The submitted draft must— (a) be in the approved form; and
(b) be
accompanied by the fee prescribed under a regulation; and
(c) include any
matter prescribed under a regulation.
(3) Also, if an approval has not been
given under part 2 for the project, the submitted draft must be accompanied by
the following— (a) a written description of the project and the operational
land;
(b) a list stating the name and address of each person the proponent
proposes as an interested person for the project; Example of persons who may
be proposed as an interested person— an unincorporated community or
environmental body with a financial or non-financial interest in the local
government area that the operational land is in
(c) a statement of how the
proponent proposes to consult with the interested persons;
(d) a list of the
names and addresses of the affected persons for the project;
(e) a summary of
the potential adverse environmental impacts of the project, and the measures
proposed to avoid or minimise the adverse impacts.
