ENVIRONMENTAL PROTECTION ACT 1994 - SECT 485
Consent to entry
485 Consent to entry
(1) This section applies if an authorised person intends to seek the consent
of an occupier of a place to an authorised person entering the place under
this chapter.
(2) Before seeking the consent, the authorised person must
inform the occupier— (a) of the purpose of the entry; and
(b) that anything
found and seized may be used in evidence in court; and
(c) that the occupier
is not required to consent.
(3) If the consent is given, the authorised
person may ask the occupier to sign an acknowledgement of the consent.
(4)
The acknowledgement must— (a) state the occupier was informed— (i) of the
purpose of the entry; and
(ii) that anything found and seized may be used in
evidence in court; and
(iii) that the occupier was not required to consent;
and
(b) state the occupier gave the authorised person consent under this
chapter to enter the place and exercise powers under this chapter.
(5) If the
occupier signs an acknowledgement of consent, the authorised person must
immediately give a copy to the occupier.
