Administering authority may issue replacement documents
621 Administering authority may issue replacement documents
(1) The administering authority may, for an activity being carried out under
an environmental authority mentioned in section 619(1), give to the person
carrying out the activity— (a) if the activity was carried out at 1
location—a development approval for the location; or
(b) if the activity
was carried out at more than 1 location and is not a mobile and temporary
environmentally relevant activity—a development approval for each location;
or
(c) if the activity is a mobile and temporary environmentally relevant
activity—a development approval for a mobile and temporary environmentally
relevant activity.
(2) If the person carrying out the activity does not have
a registration certificate for the activity, the administering authority may
also give the person a registration certificate for the activity.
(3) The
development approval must contain the same details about the activity and
conditions for carrying out the activity as were contained in the authority.
(4) If the administering authority acts under subsection (1) or subsections
(1) and (2), the administering authority must give the person carrying out the
activity an information notice about the administering authority’s decision
to give the approval or approval and certificate.
(5) The approval or
approval and certificate have effect and the environmental authority is
cancelled— (a) if there is no appeal against the administering authority’s
decision under subsection (4)—from the day after the appeal period expires;
or
(b) if there is an appeal against the administering authority’s decision
under subsection (4)—from the day after the appeal is finally decided or is
otherwise ended.
