Procedure for an appeal to the court
78 Procedure for an appeal to the court
(1) An appeal to the court is started by filing notice of appeal with the
clerk of the court.
(2) A copy of the notice must be served on the chief
executive.
(3) The notice of appeal must be filed— (a) if the chief
executive gave a review notice of the review decision to the applicant within
the 30 business days mentioned in section 76 (1) —within 28 days after the
review notice day; or
(b) otherwise—within 28 days after the end of the 30
business days mentioned in section 76 (1) .
(4) The court may, whether before
or after the time for filing the notice of appeal ends, extend the period for
filing the notice of appeal.
(5) The notice of appeal must state fully the
grounds of the appeal.
