Offer to winner of ballot or tender

120 Offer to winner of ballot or tender

(1) The winner of a ballot or tender must be made an offer on the terms stated in the sale notice.
(2) If the offer is refused—
(a) the applicant’s deposit is forfeited to the State; and
(b) either—
(i) if the offer was made because of a ballot—the chief executive may reballot the land; or
(ii) otherwise—the Minister or chief executive may deal with the land in a way required or permitted under this Act.
(3) Only the applicants included in the earlier ballot, other than the applicant who refused the offer, are to be included in the reballot.
(4) An applicant who is eligible to be included in the reballot, by notice to the chief executive, may withdraw from the reballot.
