Power to reduce term of lease or impose additional conditions
214E Power to reduce term of lease or impose additional conditions
(1) This section applies if a lessee is convicted of an offence against
section 214D (1) , whether or not a remedial action order is made.
(2) The
Minister may decide to do all or any of the following— (a) reduce the term
of the relevant lease;
(b) impose additional conditions on the lease;
(c)
require a land management agreement to be entered into for the lease land.
(3) However, the Minister can not reduce the term by an amount that results in
the lease no longer having an unexpired term. Note— Under section 234 (f) ,
a breach of a remedial action order is a ground for forfeiting a lease.
(4)
If the relevant lease is a perpetual lease, the reduction may be made by
changing the lease to a term lease of a stated term.
