Revoking a resumption
222 Revoking a resumption
(1) A resumption may be revoked by repealing the order in council effecting
the resumption.
(2) The revocation may be made only before compensation has
been paid or decided by the court.
(3) On repeal of the order in council, the
resumption is taken not to have happened.
(4) However, a compensation
claimant is entitled to claim compensation only for loss, reasonable costs and
expenses incurred by the claimant in relation to the resumption before it was
revoked.
(5) The Minister must decide the amount of the loss, costs and
expenses.
(6) The compensation claimant may appeal against the Minister’s
decision.
