LAND ACT 1994 - SECT 287

Registered documents must comply with particular requirements

287 Registered documents must comply with particular requirements

(1) A document may be registered only if—
(a) the document is in the appropriate form and correctly executed; and
(b) the document complies with the directions of the registrar of titles about—
(i) how the appropriate form must be completed; and
(ii) how information to be included in or given with the document must be included or given; and
(c) if the Minister’s or chief executive’s approval is needed—the Minister or chief executive has given written approval to the transaction to which the document relates.
Note—
For the registration of particular documents under the Forest Wind Farm Development Act 2020 , see also part 3 , division 5 and part 4 , division 6 of that Act.
(2) However, if a document is not in the appropriate form, it may be registered if the registrar of titles is satisfied it is not reasonable to require the document to have been executed in the appropriate form.
(3) Also, a document that does not comply with a direction mentioned in subsection (1) (b) may be registered if the registrar of titles is satisfied it is reasonable to not require the compliance.
(4) Subsections (2) and (3) do not apply to an electronic conveyancing document.
