373AB Compliance with s 373A

(1) A registered document of covenant is taken not to be registered under this Act to the extent it is inconsistent with section 373A .

(2) Subsection (1) has effect only in relation to documents of covenant registered after the commencement of this section.

(3) The registrar of titles may refuse to register a document creating or purporting to create a covenant if the registrar is satisfied it is to any extent inconsistent with section 373A .

(4) However, the registrar of titles need not consider whether a document creating or purporting to create a covenant complies with section 373A (9) (b) .
