Effect on writ of execution of transfer after sale by chief executive
389B Effect on writ of execution of transfer after sale by chief executive
(1) This section applies if— (a) a writ of execution has been registered in
relation to a lease; and
(b) the chief executive has sold the lease under
chapter 5 , part 4 , division 3A , subdivision 4 .
(2) If the chief executive
executes a transfer of the lease for the purposes of the sale— (a) the
registration of the writ of execution does not prevent registration of the
transfer; and
(b) on registration of the transfer, the registrar of titles
must cancel registration of the writ of execution.
