State trustee powers and delegation
53A State trustee powers and delegation
(1) If the State is the trustee of trust land, the State may only exercise,
for the trust land, powers that are not inconsistent with this Act.
(2) A
relevant Minister for trust land may delegate a power of the State as trustee
of trust land to an appropriately qualified officer of the State.
(3) In this
section—
"appropriately qualified" includes having the qualifications, experience or
standing appropriate to exercise the power. Example of standing— a
person’s level of employment in the entity in which the person is employed
"officer of the State" means a public service officer and any other person
employed in a public sector unit.
"relevant Minister" , for trust land, means the Minister having responsibility
for the State for administering the trust land.
