Licensed insurer can not decline CTP business
22 Licensed insurer can not decline CTP business
(1) A CTP insurance policy under this Act is binding on the licensed insurer
by force of this Act, and a licensed insurer can not repudiate, or decline to
issue or renew, a CTP insurance policy.
(2) If an application is made to a
licensed insurer for an insurance certificate for use in connection with an
application to register or renew the registration of a motor vehicle, and the
appropriate insurance premium is tendered to the insurer by the applicant, the
insurer must issue the certificate. Penalty— Maximum penalty—300
penalty units.
(3) A court that convicts an insurer of an offence against
subsection (2) may, by order, withdraw the licence.
