Court’s power to enforce compliance with divs 2, 3 and 4
50 Court’s power to enforce compliance with divs 2, 3 and 4
(1) If a claimant fails to comply with a duty imposed under division 2 , 3 or
4 , the court may, on the insurer’s application, order the claimant to take
specified action to remedy the default within a time specified by the court.
(2) If an insurer fails to comply with a duty imposed under division 3 or 4 ,
the court may, on the claimant’s application, order the insurer to take
specified action to remedy the default within a time specified by the court.
(3) The court may make consequential or ancillary orders.
