Exclusion of summary judgment on the basis of admissions
52B Exclusion of summary judgment on the basis of admissions
(1) In an action for damages for personal injury arising out of a motor
vehicle accident, summary judgment is not to be given on the basis of the
defendant’s admissions.
(2) However, this section does not prevent a court
from giving a judgment by consent.
