MENTAL HEALTH ACT 2016 - SECT 42
Revocation
42 Revocation
(1) A doctor or authorised mental health practitioner who makes a
recommendation for assessment for a person may revoke the recommendation at
any time before the start of the assessment period for the person.
(2) The
doctor or authorised mental health practitioner may act under subsection (1)
only if the doctor or health practitioner is no longer satisfied— (a) the
treatment criteria may apply to the person; or
(b) there appears to be no
less restrictive way for the person to receive treatment and care for the
person’s mental illness.
