MENTAL HEALTH ACT 2016 - SECT 621

621 Offence relating to ill-treatment

(1) This section applies to a person who, under this Act—

(a) is assessing, examining, providing treatment and care to, or detaining, a person (the
"patient" ); or

(b) is responsible for the detention of a person (also the
"patient" ).

(2) The person must not ill-treat the patient.

Penalty—

Maximum penalty—200 penalty units or 2 years imprisonment.

(3) In this section—

"ill-treat" includes to wilfully abuse, neglect or exploit.
