MENTAL HEALTH ACT 2016 - SECT 681
Mental Health Court may direct person’s discharge
681 Mental Health Court may direct person’s discharge
(1) This section
applies if, after considering the evidence before it, including any report
prepared by the appointed person, the Mental Health Court is satisfied the
person’s detention in the relevant service is unlawful.
(2) The court must,
by order, direct that the person be immediately discharged from the relevant
service.
(3) The administrator of the relevant service must ensure the order
is complied with.
