Revocation of special wildlife reserves
43J Revocation of special wildlife reserves
(1) A regulation may revoke the declaration of all or part of a special
wildlife reserve.
(2) The regulation may be made only if the Legislative
Assembly has, on a motion of which at least 28 days notice has been given,
passed a resolution requesting the Governor in Council to make the revocation.
(3) Subsection (2) does not apply if the regulation— (a) makes a minor
change to the boundaries of a special wildlife reserve and the Minister is
satisfied the change does not adversely affect the conservation of nature; or
Example for paragraph (a)— changing the boundaries of a special wildlife
reserve to align with a new survey of an existing road
(b) increases the
area of land in a special wildlife reserve and the Minister is satisfied the
increase does not adversely affect the conservation of nature; or
(c)
dedicates the land subject of the revocation as a national park (scientific)
or a national park.
(4) If the regulation revokes the declaration of all of a
special wildlife reserve, the conservation agreement and management program
for the reserve end on the revocation.
(5) If the regulation revokes the
declaration of part of a special wildlife reserve, on the revocation, the
conservation agreement and management program for the reserve stop having
effect in relation to the land removed from the reserve.
