Right of peaceful assembly
5 Right of peaceful assembly
(1) A person has the right to assemble peacefully with others in a public
place.
(2) The right is subject only to such restrictions as are necessary
and reasonable in a democratic society in the interests of— (a) public
safety; or
(b) public order; or
(c) the protection of the rights and
freedoms of other persons.
(3) In subsection (2) (c) , a reference to the
rights of persons includes a reference to— (a) the rights of members of the
public to enjoy the natural environment; and
(b) the rights of persons to
carry on business.
(4) Nothing in this section limits the power of a local
authority to regulate pedestrian malls, but the power is subject to the right
mentioned in subsection (1) .
