161X When court may make order—offender convicted of habitual consorting
(1) A court sentencing an offender for an offence against the Criminal Code ,
section 77B may make a control order for the offender if— (a) section 161R
does not apply to the sentencing of the offender; and
(b) the court considers
that making the order is reasonably necessary to protect the public by
preventing, restricting or disrupting the offender’s involvement in serious
criminal activity.
(2) A control order may be made under subsection (1) on
the court’s own initiative or on an application by the prosecutor.
