Notice of adverse incidents
20G Notice of adverse incidents
(1) A person who provides medical treatment to a child may give a parent or
legal guardian of the child a written notice of an adverse event arising out
of the treatment.
(2) The notice may be accompanied by an expression of
regret under the Civil Liability Act 2003 , chapter 4 , part 1 or an offer to
remedy any harm suffered as a result of the incident, or both an expression of
regret and offer.
(3) A notice of an adverse event is not an admission of
liability and is inadmissible in any subsequent proceeding in relation to the
event, other than a proceeding mentioned in section 20H .
(4) A person who
gives a notice of an adverse event must as soon as practicable after giving
the notice give to the public trustee a copy of the notice and any document
provided to a parent or legal guardian with the notice.
