Duty of respondent to give documents to contributor
28 Duty of respondent to give documents to contributor
(1) A respondent must give a contributor for the claim added by the respondent
copies of the following in the respondent’s possession— (a) reports and
other documentary material about the incident alleged to have given rise to
the personal injury to which the claim relates;
(b) reports about the
claimant’s medical condition or prospects of rehabilitation;
(c) reports
about the claimant’s cognitive, functional or vocational capacity;
(d)
reports about the claimant’s personal injury and of any consequent
disabilities;
(e) if applicable, information about the medical treatment and
rehabilitation services the claimant has sought or obtained;
(f) information
about the claimant’s medical history, as far as it is relevant to the claim,
and any other claims for damages for personal injury made by the claimant;
(g) information about the claimant’s claim for past and future economic
loss;
(h) information about any claim known to the respondent for gratuitous
services or loss of consortium or servitium consequent on the claimant’s
personal injury.
(2) The respondent must give the copies— (a) within the
period prescribed under a regulation or, if no period is prescribed, within 1
month after giving a contribution notice to the contributor; and
(b) to the
extent any report, documentary material or information comes into the
respondent’s possession more than 1 month after giving the contribution
notice, within 7 days after it comes into the respondent’s possession.
